This is a common issue on the E46.

It has to do with the EGR-looking thing that attaches to the exhaust side of the cylinder head. There are several modes of failure, from cracked hoses to actual failure of the secondary air pump (which usually makes horrific squealing sound prior to failing completely).

Another common cause is carbon buildup in the passages within the head that are related to this system. Some folks seem to have luck cleaning them out somehow, although exactly how, I don't remember.

So by the way I fixed the problem wed night. Cleared codes, and they haven't been back after a few days driving around.

Turned on the car, had the Volt meter ready... heard the air pump come on so that ain't it. Looked at the exhaust and noticed a vacuum line broken off the valve actuator. Bought 1 foot of hose from Autozoo for $1.39 and voila... here's the offending hose:
