It would seem to exempt machine guns, but that any other NFA items are not subject to any tax or registration.

State's rights are upheld unless 1. They violate the Constitution (incorporation under the 14th Amendment) or 2. They are preempted by federal law.

What the Montana bill is trying to say is that guns made, sold, and used in Montana cannot be regulated under federal law because they are not "in commerce" because they don't cross state lines and the only way the feds could regulate it would be under the Commerce Clause of the Constitution. This isn't the correct legal analysis though, as the Supreme Court has consistently held that items of commerce do not have to cross state lines in order for the federal government to regulate them under the commerce clause.

Most recently this was address in Gonzales v. Raich, which held that the federal government could regulate, under the Commerce Clause, marijuana cultivated, grown, and used in California by a medical marijuana patient. It's a pretty clear cut analysis under the precedent.
