Not at all the point. The point is, that they would frequently ask Brennan the simple fucking question of whether or not it would be constitutional to do so if they felt as though the posed a threat (sitting at a cafe, as they so eloquently put it). To which he responded for the entirety of the filibuster, that he didn't think that they would find that particular use appropriate. It was a simple yes or no fucking question. Big government 1984 .
